Terms of Service

These Terms of Service ("Terms") govern your use of the NextScout platform ("Platform") operated by NextScout ("we", "our", "us"). By creating an account or using the Platform, you agree to these Terms.

1. Eligibility

To use NextScout you must:

• Be at least 14 years of age
• If under 18, have obtained verifiable parental or guardian consent
• Provide accurate and complete registration information
• Not be prohibited from using the Platform under applicable law

2. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

You may register as a Player (individual aged 14–21 seeking opportunities) or as a Club / Scout (organization or individual seeking talent). Each account type has different access levels and features.

3. Platform Nature, Exposure Only

NextScout is a visibility and exposure platform that unifies player profiles, professional offers and opportunities in one place. We provide tools that allow players to create profiles and be discovered by clubs, scouts and universities. We expressly do not:

• Guarantee any recruitment, contract, scholarship or opportunity
• Act as an agent, intermediary or representative of any player, club, scout or university
• Have any authority or power to select, recommend or favor any candidate, every decision to trial, hire, sign or reject remains solely between the parties involved
• Verify the legitimacy, financial standing or intentions of clubs or organizations registered on the platform
• Guarantee the accuracy of information provided by third-party organizations

Any contact, agreement or arrangement made between players and organizations through NextScout is solely between those parties. NextScout is not a party to any such arrangements and bears no responsibility for their outcome.

Verification scope. NextScout only stands behind professionals who carry our own verification seal, issued after our team checks their qualification and confirms their experience. Any other user, professional or piece of content on the Platform without that seal has not been evaluated or supervised by NextScout, and we assume no responsibility for it.

4. Player Accounts, Acceptable Use

As a player, you agree to:

• Provide accurate and truthful information in your profile
• Only upload content (videos, photos) that you own or have the right to use
• Not impersonate any other person or misrepresent your identity, age, skills or experience
• Not upload content that is offensive, illegal, defamatory or violates any third party's rights
• Keep your profile information up to date

5. Club & Scout Accounts, Acceptable Use

As a club or scout, you agree to:

• Provide accurate information about your organization
• Only contact players for legitimate sporting, academic or professional purposes
• Not use player data for marketing, spam or any purpose unrelated to talent scouting
• Comply with all applicable labor, immigration and child protection laws when engaging with players
• Not make misleading or fraudulent offers to players

6. Subscriptions and Payments

Player subscriptions (Basic, Premium, Pro) and the professional Job Access subscription are billed monthly or annually as stated on the pricing page. All payments are processed securely by Stripe.

• Subscriptions auto-renew unless cancelled before the renewal date
• Refunds are available within 7 days of purchase if no plan benefits have been used
• No refund is issued on the grounds that a subscription did not result in a trial, contract, offer or any other successful outcome. Payment is for access and visibility on the Platform, not for a guaranteed result
• We reserve the right to change pricing with 30 days' notice to existing subscribers
• Club and scout access is free and does not require a subscription

7. Professional Services & Commission

Professionals (coaches, physios, analysts, nutritionists, agents and similar) may list services on the Platform free of charge. When a club, scout or player books a professional's service through NextScout:

• Payment for the service is held by NextScout for 30 days after the service is delivered, to allow either party to raise an issue
• NextScout's share of the first booking between any two given parties is 50%, and the professional receives the remaining 50%
• From the second booking between the same two parties onward, NextScout's share drops to 20%, and the professional receives 80%
• Payouts to professionals are processed via Stripe Connect once the 30-day hold period ends

NextScout only vouches for professionals carrying our verification seal, as described in Section 3. Booking a professional through the Platform does not make NextScout a party to the service agreement itself.

8. Referral Program

Eligible users may participate in our referral program and receive 1 month free per successful referral. Referral rewards are applied to the next billing cycle. We reserve the right to modify or terminate the referral program at any time. Abuse of the referral system will result in account suspension.

9. Intellectual Property

You retain ownership of all content you upload (photos, videos, profile data). By uploading content, you grant NextScout a non-exclusive, worldwide, royalty-free licence to display, reproduce and distribute that content on the Platform for the purpose of operating the service.

The NextScout name, logo, design and platform code are the intellectual property of NextScout and may not be used without prior written permission.

10. Prohibited Conduct

You may not:

• Use the Platform for any unlawful purpose
• Scrape, crawl or extract data from the Platform without authorization
• Attempt to gain unauthorized access to any part of the Platform
• Upload malicious code, viruses or harmful content
• Harass, threaten or abuse other users
• Create multiple accounts to circumvent restrictions or bans

11. Limitation of Liability

To the maximum extent permitted by applicable law, NextScout shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of earnings, loss of opportunities, or any harm arising from reliance on information provided by third-party organizations on the Platform.

Our total liability to you for any claims arising from your use of the Platform shall not exceed the total amount paid by you to NextScout in the 12 months preceding the claim.

12. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free or free of harmful components.

13. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct harmful to other users, the Platform or third parties. You may delete your account at any time from your account settings.

14. Operator & Governing Law

NextScout is operated by Delta International Consultancy LLC, a Delaware limited liability company.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Platform. Continued use after changes take effect constitutes acceptance of the updated Terms.
